Conditions of Access to the Site

Any person (hereinafter “the user”) accessing the present Internet site (hereinafter “the site”) is assumed to have accepted unconditionally all the provisions and conditions of use of the site of the owner, (hereinafter “the publisher“).

The site is accessible at all times anywhere in the world. The user who connects to it bears sole responsibility for compliance with the legislation and/or regulations in force in the country where he/she resides or from where he/she connects to the site.

Data Security

The publisher uses Security Sockets Layer (SSL) encryption technology to encrypt sensitive personal information before it travels over the internet.

The publisher follows generally accepted standards to protect the personal information submitted, both during transmission and once the publisher receives it. Processing of Personal Data

 
  1. In the following, we provide information about the collection of personal data when concluding business transactions. Personal data is all data that can be related to you personally, including e.g. name, first name, address, email addresses, payment details, license plate and VIN numbers. The controller according to Art. 4 Para. 7 GDPR is TransSport S.A. - DriveMarket, 34 route d'Ettelbruck, L-9230 Diekirch.
  2. We collect, store and, if necessary, pass on the data to the extent necessary to provide the contractual services. The collection, storage and transfer takes place for the purpose of fulfilling the contract and on the basis of Article 6 Paragraph 1 Sentence 1 Letter b GDPR. Failure to provide this data may result in the contract not being concluded. These contractual services can include the following purposes; the data necessary to fulfill the contract will be transferred to the respective processor:
    • For the purpose of taking back your old vehicle, your personal data, which is written on the grey card or vehicle invoices, may be passed on to the reseller(s). This is done, among other things, to enable the registration of the vehicle and cross-border sale.
    • Your personal data will be transmitted to the registration office for vehicle registration or presentation, and in some cases also passed on to transport and driving service providers.
    • For the purpose of processing claims settlement, your personal data will be passed on to your insurer and its assessor.
    • For the purpose of data reconciliation, invoicing and claims processing, your personal data and accident reports will be transferred to your leasing company.
    • To create an extended warranty for your vehicle, your personal data will be transferred to insurance companies.
    • In order to send you videos or photos of the damage found on your vehicle, your personal data will be transmitted to a service provider.
    • For the purpose of adding or modifying your vehicle, your personal data will be passed on to the commissioned bodywork company or modification manufacturers.
    • For tyre storage or the pick-up and delivery service, your personal data will be passed on to the relevant service providers.
    • If we offer you financing, we will pass on your data to the commissioned financing company as this is required to prepare the financing offer.
    • When concluding a rental car contract, the following data is collected, processed and, if necessary, passed on.
    • The rental vehicles are equipped with geo-tracking and other technologies that enable, among other things, an analysis of driving behavior, determination of the route and location.
    • In order to determine damage or in the event of violations of the road traffic regulations, we will pass on your data to the insurance company and the investigating authorities.
    • When you sign a rental car contract, your personal data may be transferred to a service provider. In addition, a copy of your photo ID and driver's license will be created and stored.

  3. In addition to the services listed under (2), data processing operations are also carried out with the aim of fulfilling the following purposes:
    • Further development of products, services and support offers as well as other measures to control business transactions and processes;
    • Improving product quality, eliminating errors and malfunctions, among other things, through the analysis of vehicle data and customer feedback;
    • Processing of data in a central prospect and customer support platform as well as upstream and downstream systems for customer loyalty and sales purposes for the individual support of customers and prospects;
    • Handling of warranty and goodwill cases, processing of non-contractual inquiries and concerns from interested parties and customers;
    • Analysis needs and customer segmentation, e.g. calculation and evaluation of affinities, preferences and potentials;
    • Ensuring compliance with the law, preventing and protecting against legal violations (in particular criminal offenses), asserting and defending against legal claims; protecting the company and its affiliated companies;
    • Ensuring availability, operation and security of technical systems as well as technical data management.
  4. The payment data is transmitted to the respective payment provider according to the payment method selected by the buyer. The payment provider is responsible for the payment data. The information, in particular the service responsible for the buyer's payment service provider, the details of data protection officers at payment service providers and the categories of personal data processed by payment service providers, are available from the respective payment service provider.
  5. We maintain up-to-date technical measures to ensure the protection of personal data. These are always adapted to the current state of the art.
  6. We reserve the right to adapt or modify our data protection notices in order to comply with changes in the law, new developments in case law or economic or technical changes. This does not affect the essential provisions of the contractual relationship.

Use of Cookies

Cookies set by the site

Like most sites, the site makes use of cookies. Cookies are small, innocuous text files that in no way affect the privacy of the user or the security of the user’s device.

The site uses cookies to enhance the user experience and improve performance.

Web Analytics Cookies

Use of Google Maps

The site may use Google Maps API, a map service provided by Google, Inc. (“Google”), in order to visually display geographical information or 360° virtual tours of the locations(s) of the publisher. By using Google Maps, data about map usage is collected, stored in cookies and transferred to Google. More information about data processing by Google can be found in the Google Privacy statement. This is where the user can modify his or her personal privacy settings for Google services.

Embedded Youtube Videos

The site may contain embedded videos hosted on YouTube, operated by YouTube LLC CA, USA. When visiting a page containing an embedded YouTube video, information about the user’s view and usage of this video is collected, stored in cookies and transferred to YouTube. If the user’s browser is authenticated to YouTube, the user’s personal identification may also be transferred to YouTube.

The user may avoid this personal identification by logging out of YouTube before using the site.

Embedded Facebook Plug-Ins

The publisher uses the Facebook Plugin, a service provided by the social media network facebook, Inc. (“Facebook”).

When the user visits a page containing an embedded Facebook Plugin (feed, Like buttons, sharing buttons), the plugin’s files are loaded from Facebook servers and Facebook will thereby obtain information about the users IP address, the page he visited as well the date, time of this visit.

In case the user’s browser has previously logged in to the users account on the the Facebook.com website, Facebook will be able to identify the user and associate his visit to the publisher’s website to his account. Also, any interaction of the user with the Facebook plugin is tracked by Facebook and may be published on the users Facebook profile.

The user may refuse this behavior by logging out of Facebook.com prior to his visit of the publisher’s website, or by making use of a browser add-on blocking the tracking by Facebook.
